Conditional Use Permit
Conditional Uses are special uses embodied in the different zoning districts that are permitted only upon review by the Planning and Zoning Commission and approval of the County Council.  

Before authorizing the issuance of a conditional use permit, the County Council may impose such conditions that will, in the County Council's judgment, insure that:

      a.   The establishment, maintenance, or operation of the conditional use will not be detrimental to or
             endanger the public health, safety, comfort or general welfare.

      b.   The conditional use will not be injurious to the use and enjoyment of other property in the immediate
             vicinity for the purposes already permitted nor substantially diminishes and impairs property values
             within the neighborhood.

      c.   The establishment of the conditional use will not impede the normal and orderly development and
             improvement of surrounding property for uses permitted in the zoning district.      

      d.   Adequate utilities, access roads, drainage and/or other necessary facilities will be provided.      

      e.   Adequate measures will be taken to provide ingress and egress designed to minimize traffic 
            congestion in the public streets.   

The conditional use shall, in all other respects, conform to the applicable regulations of the zoning district in which it is located and the County Council shall find that there is a public necessity for the conditional use.    

The fee for filing an application for a conditional use permit is $400.00.  The fee for filing an application for a conditional use permit in conjunction with a rezoning is $150.00.   

HOW TO APPLY FOR A CONDITIONAL USE PERMIT:   

1.  You will want to call or visit the County Planning and Zoning Division at 201 North Second Street, Room
     420, in St. Charles, Missouri 63301, 636-949-7335 and a staff member will discuss your options with you. 
     If a Conditional Use Permit is necessary, the application can be given to staff or mailed to our office.  When
     applying for the Conditional Use Permit you will need to supply the County Planning and Zoning Division
     with:    

     a.    A legal description of the tract.   

     b.    A recent certificate of title or deed to the property showing ownership.   

     c.    A site sketch to indicate the intended use and future development of the property.    

     d.    The owner of the tract must sign the application or provide an affidavit to the effect that the person  
            making the application is authorized to do so.   

     e.   The filing fee must be paid at the time the application is submitted.  If you are paying by check, make it
           payable to St. Charles County Planning and Zoning Division.   

2.  There is usually a 4 to 8 week period between the filing of your application and the date of the Public
      Hearing.  This period of time is due to a required period for legal advertisements, time to prepare and mail
      notices of the hearing to property owners within 500 feet and other administrative details.  Click here for the

3.  The applicant or his/her representative must be present at the Public Hearing to explain their proposal to
      the County Planning and Zoning Commission.  The County Planning and Zoning Commission will then
      allow others at the hearing to speak for or against the proposal.  After everyone has spoken, you will be
      given the opportunity for a rebuttal of the comments presented.  Remember to keep your comments
      concise and pertinent to the Conditional Use Permit.    

4.  A recommendation will be made during the Regular Meeting following the Public Hearing, unless voted to
     be tabled by three (3) Commissioners for additional review and/or information.  After a recommendation is
     rendered by the Commission, the application will then be forwarded to the St. Charles County Council.    In
     making a recommendation, the County Planning and Zoning Commission will consider such areas as:
     surrounding zoning and development in the area, future traffic generation data, arterial road and highway
     plans, availability of utilities, comments presented during the Public Hearing and the planning staff's
     recommendation.   

5.  The County Planning and Zoning Commission's recommendation to grant or deny the conditional use 
     permit application will be forwarded to the County Council.  The County Council will then vote to either 
     approve or deny the conditional use permit application at a later meeting.   

6.  If the County Council votes to approve your Conditional Use Permit, you may then apply for any necessary 
     Building and Land Use Permits.
